Initiative backers ask judge to penalize ATS for its lawsuit

Transportation Safety Coalition has asked a judge to penalize American Traffic Solution for filing what TSC calls a SLAPP suit, or a Strategic Lawsuit Against Public Participation.

In a filing in Whatcom County Superior Court dated Monday, attorney Stephen Pidgeon asked the judge to award his client, TSC, attorneys fees and to impose a $10,000 fine against ATS.

ATS filed a lawsuit seeking to keep the Bellingham initiative restricting traffic-enforcement cameras off the ballot. If ATS fails, it’ll go on the November general election ballot. The company has a contract with the city of Bellingham through which is plans to install four red-light cameras and two school-zone speed cameras.

A judge on Wednesday, Aug. 17, is scheduled to consider the request to keep the initiative off the ballot. TSC, which is backing the initiative, asked him to reject the motion and impose the penalties.
