So much for "you have nothing to fear if you do nothing wrong"

Camera proponents like to say "you have nothing to fear if you have done nothing wrong" or say the camera is "accurate".

Well tell that to people down under FALSLY ACCUSED!   Because people are assumed guilty and you have to pay for the "privlage" of being declared innocent, hundereds of motorists were fined falsly!

THE recipients of 900 fines incorrectly recorded by a faulty North Narrabeen speed camera and last week repealed by the RTA have Manly’s Ted Critchley to thank. Mr Critchley wrote a letter to the RTA after receiving two penalty notices at the Pittwater Rd site, a complaint which helped trigger the fine recall after the camera was inspected

“I was well aware of the cameras, I do the same strip each day,” he said.

“I always make sure when I cross the camera that I’m at the correct speed.”

Both of Mr Critchley’s offences were for an identical 12km/h over the limit in the space of just more than one month late last year.

“When it came to the second time in the same lane doing the same thing ... I was very suspicious.”

The RTA announced on Friday that all offences recorded in the first southbound lane by the fixed camera - located in a school zone outside Narrabeen Sports High - since its installation last April would be cancelled. Mr Critchley said he initially paid the fines, believing that it would not be worth challenging them in court without concrete proof, although he correctly guessed a faulty lane sensor was delivering the incorrect speeds.

“I only paid because I didn’t have enough time to submit my letter, because of the difficulty in getting in contact with the RTA.”

While the fine recall is welcome news for many, NRMA director Geoff Toovey called for the RTA to assess compensation for drivers who have incorrectly suffered licence suspensions or cancellations at the site.

“Having to reverse 900 speed camera offences due to faulty equipment is unacceptable and the RTA must do everything it can to make it right,” he said. “This highlights the need for all aspects of a speed camera’s functionality to be regularly checked.”

A spokesman for the RTA said the organisation conducted tests of all operational speed camera sites “at least once every 30 days”.

The RTA did not respond before deadline to the Manly Daily’s questions on how the Pittwater Rd camera sensor remained faulty for up to 10 months.
