Illegal Speed Camera Van taken off of road in Juno Beach
(Note: Towns really need to realize that most Floridian don't want photo enforcement, one of the reasons many towns DON'T want the public to vote on it. JUNO BEACH — The white speed van has vanished, but town officials say the camera-toting vehicle could be back.
The town council decided to yank the vehicle until contract disagreements are worked out with LaserCraft, the Georgia-based company that owns and maintains the van. The town also voted to suspend a plan that would have used cameras to fine motorists who don't stop for red lights at two locations on Donald Ross Road.
LaserCraft keeps about 20 percent of the fines.
It's the future of that 20 percent — $149,495 so far — that resulted in the suspension of the town's Safe Streets Program that includes LaserCraft's van and red-light cameras. Under the current contract with Juno Beach, LaserCraft is under no obligation to pay money back if the fines from the van or cameras are declared illegal in court.
That's why Councilman Jim Lyons was the lone dissenter in the Wednesday vote, because he wants to kill the program altogether.
"LaserCraft already told us they won't give the town back what they collected. Why should we waste money paying for more lawyers?" Lyons said.
But Mayor Mort Levine expects the town and LaserCraft to work out the dispute. Legal challenges against the van and cameras were not the reason for the suspension of the program, he said, and motorists who have received fines in the mail still are required to pay and no refunds will be issued.
A lawsuit seeking class-action status, filed by West Palm Beach attorney Jason Weisser, against Juno Beach and LaserCraft concerning the van will continue.
And a Miami-Dade circuit court judge last month ruled that red-light cameras in Aventura are illegal, but the ruling does not apply to Palm Beach County.
"We can reinstate the van and red-light cameras once the contract problems are worked out," Levine said. "Drivers still need to be careful driving through Juno Beach. Traffic laws are still being enforced."
One driver who received an infraction is Peter Stocker, a financial adviser. He called the decision a victory for motorists who have voiced opposition to the van and cameras.
"I'm glad the town woke up and suspended the program. It's going to cost them money when the program is declared illegal in court," Stocker said.
The town has placed almost all of the $743,000 in collected fines in a rainy-day fund. About $60,000 from the fines has gone into the town's general fund. The town's overall budget is about $5.7 million, according to town records.
Juno Beach Town Attorney Leonard Rubin reminded LaserCraft officials, in a Feb. 25 letter, that the company pledged to Juno Beach to "continue to stand shoulder-to-shoulder" and that "victory will be ours at the end of the legal process."
Lyons isn't buying it.
"Why would LaserCraft agree to pay when they have already agreed not to?" he said. "I'm afraid those cameras and the van could be back out there. And Juno Beach will be left holding the bill when the cameras and van are declared illegal."
